As the name portrays, money claim in court, is for monetary compensation, as opposed to one for some other type of relief, i.e. for the return of an item (repossession) or (injunction).

These are low value claims usually below £10,000. These can be issued and initiated online or via Money Claims Centre in Salford.

It would depend on the figure being pursued and based on the value could be allocated to Fast Track or Multi Track.

You can use the court procedure and issue proceedings against individuals and businesses alike, however you must have a legal basis for your Money Claim and you must be prepared to battle this in court. Generally the subject matters of your dispute will include but not limited to a dispute with a Construction firm due to bad workmanship or a goods company for delivering faulty goods or someone simply owes you a debt, i.e. given the circumstances of your case you may have suitable ground for initiating proceedings.

In fact initiating proceedings is a very simple process and should not be a costly exercise; nevertheless it depends on the complexity of your case and the values of the Money Claim. Usually most parties endeavour to settle before trial and our justice system encourages parties to settle to minimize their costs. We tend to liaise with our clients to enhance their chances of achieving a suitable and well negotiated outcome.

Our legal system follows the concept that each party covers their own legal costs to initiate or
defend court proceedings; therefore some individuals will pursue or defend a money claim on their own behalf i.e. in a Litigant in Person capacity.  However it gets trickier when the matter is decided since the losing party is usually required to pay the winning parties costs. Furthermore, the Court has discretion over costs and can impose additional costs sanctions if a party has behaved in an unreasonable manner. An added cost award is exceedingly rare, and the court’s discretion in this matter is limited to situations in which the opponent acted unreasonable during the litigation.
